Public utilities procurement under CPV division 65 covers electricity supply, gas distribution, water supply, and district heating services procured by public authorities for their facilities. This division overlaps significantly with CPV 09 (energy sources) — electricity and gas supply for buildings often appears under either division depending on the contracting authority's classification approach. Public utilities are also significant procurers themselves — water companies, gas distributors, and energy suppliers covered by the EU Utilities Directive (2014/25/EU) procure under a distinct legal framework with different thresholds and procedure rules than the standard procurement Directive.
The EU Utilities Directive (2014/25/EU) applies to contracting entities operating in the energy, water, transport, and postal sectors. Key differences from the standard Directive include higher financial thresholds, a negotiated procedure with prior call for competition as the standard approach, and a qualification system alternative to single-procedure tendering. Utilities can exclude suppliers from non-GPA-covered third countries for certain procurement categories. The energy transition is a dominant theme — renewable energy certificates, demand response procurement, and flexibility service contracts are emerging categories alongside traditional utility supply procurement.
