Public utilities procurement under CPV division 65 covers electricity supply, gas distribution, water supply, and district heating services procured by public authorities for their facilities. This division overlaps significantly with CPV 09 (energy sources) — electricity and gas supply for buildings often appears under either division depending on the contracting authority's classification approach. Public utilities are also significant procurers themselves — water companies, gas distributors, and energy suppliers covered by the EU Utilities Directive (2014/25/EU) procure under a distinct legal framework with different thresholds and procedure rules than the standard procurement Directive.

The EU Utilities Directive (2014/25/EU) applies to contracting entities operating in the energy, water, transport, and postal sectors. Key differences from the standard Directive include higher financial thresholds, a negotiated procedure with prior call for competition as the standard approach, and a qualification system alternative to single-procedure tendering. Utilities can exclude suppliers from non-GPA-covered third countries for certain procurement categories. The energy transition is a dominant theme — renewable energy certificates, demand response procurement, and flexibility service contracts are emerging categories alongside traditional utility supply procurement.

Contract notices under CPV division 65 are published by contracting authorities across all 27 EU member states on TED Europa. Verify current deadlines directly on TED before beginning bid preparation, as corrigenda (correction notices) may have modified the original published deadline. Estimated values shown are from the original contract notice — final awarded values are disclosed in Contract Award Notices published after the procedure concludes.

Frequently Asked Questions — CPV 65

What is the EU Utilities Directive and when does it apply?
Directive 2014/25/EU (Utilities Directive) applies to contracting entities operating in the water, energy, transport, and postal sectors — including public utilities, private entities with special or exclusive rights, and public undertakings in these sectors. It sets higher EU procurement thresholds than the standard Directive (currently €443,000 for supplies/services, €5.4 million for works). Utilities can use negotiated procedures with prior publication as their default approach, giving more flexibility than the standard Directive.
How do public authorities procure electricity and gas for their buildings?
Above-threshold electricity and gas supply contracts for public buildings must be competitively tendered — typically through open procedure or framework agreement. National CPBs often run energy supply frameworks for government use with pre-qualified suppliers at volume-discounted rates. Renewable electricity (with Guarantee of Origin certificates) is increasingly specified as a mandatory requirement. Multi-year energy supply contracts with price indexation to market benchmarks are standard for large consumers.
Can contracting authorities use dynamic purchasing systems for utility procurement?
Yes — Dynamic Purchasing Systems (DPS) are permitted for utility supply contracts under both Directive 2014/24/EU and Directive 2014/25/EU. A DPS for energy supply would allow new energy suppliers to join throughout the system period without closing the market. Mini-competitions are then run among admitted suppliers for individual supply contracts. DPS is particularly suited to energy markets where supplier eligibility evolves over time as renewable capacity and retail licences change.
