Defense EU Tenders — Market Overview

EU defence and security procurement operates within a distinct legal framework that partially overlaps with, but is not fully governed by, EU Directive 2014/24/EU. Directive 2009/81/EC specifically governs defence and sensitive security procurement above defined thresholds, allowing contracting authorities to apply stricter security conditions, information classification requirements, and supply chain controls. Defence contracts above €431,000 (supplies/services) or €5.4 million (works) must be published on TED under this directive.

European defence procurement has undergone significant structural change since Russia's invasion of Ukraine in 2022. NATO members across the EU have committed to increasing defence spending to 2% of GDP and above, generating unprecedented procurement volumes for military equipment, logistics, communications infrastructure, cybersecurity, and defence services. The EU's Defence Investment Package and European Defence Fund (EDF) are channelling additional procurement stimulus into collaborative capability development programmes across member states.

Defence procurement is among the most technically and administratively complex EU tender categories. Bidders must typically hold appropriate security clearances (personnel and facility-level), demonstrate supply chain security and technology transfer controls, and meet stringent quality assurance standards (AS9100, AQAP series). Many defence contracts are classified as restricted procedures or negotiated procedures with prior publication, reflecting the security-sensitive nature of requirements. Established prime contractors frequently subcontract to specialist SMEs, creating both direct and indirect procurement participation routes.
